Terms of Use
These terms are the ground rules for using EightGig while the service is in beta. By creating or using an account, you agree to them.
What EightGig does
EightGig helps venues, acts, and sound professionals find one another and record booking terms. EightGig is not the venue, act, employer, agent, insurer, payment processor, or event producer. We do not guarantee that an open date will fill, a gig will happen, or either party will perform or pay.
We do not run background checks, verify identity, confirm licenses or insurance, or vet the people and rooms listed here. Profiles and listings are written by the people using EightGig, and reviews reflect their opinions. Booking a gig means meeting people and going places on your own judgment — check who you are dealing with, tell someone where you will be, and trust your instincts. Report anything unsafe through Help & Support.
Who may use it
You must be at least 18 and able to enter a binding agreement. You must provide accurate information, control the profiles you create, keep access to your sign-in method secure, and promptly correct material errors.
Beta and Founding Memberships
EightGig is free during beta. The first 500 eligible act profiles and first 500 eligible venue profiles we confirm as onboarded receive a Founding Membership with no recurring standard-membership fee for as long as EightGig operates and the account remains in good standing.
We count profiles in the order we confirm onboarding. To qualify, a profile must be complete, authentic, and non-duplicate. The offer is limited to one Founding Membership per real-world act or venue. We confirm Founding status after onboarding.
A Founding Membership is non-transferable and does not cover gig pay, taxes, third-party costs, or separately offered optional services. We will explain any future pricing before asking anyone to pay, and we will not charge a payment method without authorization.
Bookings and payment
A venue must publish honest pay and logistics. An offer and acceptance create a commitment between the venue and act on the displayed terms. Unless EightGig explicitly says otherwise, participants arrange and make payment directly; EightGig does not hold or guarantee gig money.
Review the venue, local date and time, address, duration, pay, sound expectations, and provided equipment before accepting. Use the product controls to cancel or raise a dispute. Repeated cancellations, no-shows, unsafe conduct, dishonest listings, or repeated copyright infringement can lead to restrictions, up to losing the account.
Your responsibilities
You are responsible for permits, taxes, insurance, worker classification, music and performance licenses, accessibility, age restrictions, safety, equipment, and compliance that applies to your role and event. Information on EightGig is general information, not legal, tax, or safety advice.
Content and conduct
Do not impersonate others; harass or discriminate; post deceptive, illegal, infringing, or unsafe content; scrape or disrupt the service; evade moderation; or use contact information outside legitimate booking activity. You keep ownership of your content and give EightGig a non-exclusive license to host, display, process, and transmit it as needed to operate and promote your listing or profile.
Moderation and account action
We may screen content, investigate reports, remove material, limit features, suspend accounts, or preserve evidence when reasonably needed for safety, booking integrity, legal compliance, or service security. You may ask for review through support.
Text messages
If you give us a phone number, we may text you about the things you asked for: sign-in codes, offers, confirmations, day-before reminders, and messages from the other side of a booking. How often depends on your own booking activity. Message and data rates may apply, and we cannot promise every message arrives on time — carriers are not always reliable.
Reply STOP to any message to stop texts, or HELP for help. Agreeing to texts is not a condition of using EightGig; keep an email address on your account and you can leave SMS off entirely. Deactivating texts does not delete your account.
Copyright
If you believe something posted here infringes your copyright, tell us through Help & Support and include: what work was infringed, where the material is on EightGig, your contact information, a statement that you believe in good faith the use is not authorized, a statement that the information is accurate and you are the owner or authorized to act for them, and your signature.
We remove material that is properly reported and tell whoever posted it. If you think your material was removed by mistake, send a counter notice the same way and we may restore it. Repeat infringement ends an account. The full procedure, including what a notice has to contain, is on the Copyright & DMCA page.
Service limits
EightGig is currently in beta. Features may change, and the service may experience interruptions. EightGig is provided as is and as available, without warranties of any kind — we do not warrant that it will be uninterrupted, error-free, or secure, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the extent the law allows, EightGig is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for acts, omissions, injury, property damage, payment disputes, or content from other participants. Where liability cannot be excluded, our total liability for any claim is limited to the greater of the amount you paid EightGig in the twelve months before the claim or one hundred U.S. dollars. Rights that cannot legally be waived remain in effect, and some states do not allow these limits — in that case they apply only as far as that state permits.
If you cause a problem for someone else
You agree to cover EightGig’s losses, including reasonable legal fees, from claims arising out of your listings, content, conduct, gigs, or failure to meet obligations you took on here — including a participant’s claim about a gig you booked or played. We will tell you about any such claim and let you participate in the defense.
Governing law and disputes
These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. Disputes with EightGig belong in the state or federal courts in Milwaukee County, Wisconsin, and both sides consent to that jurisdiction.
Before filing anything, contact us through Help & Support and give us 30 days to sort it out — most problems are a misunderstanding and end there. Nothing here stops either side from seeking relief in small-claims court, or a court order to stop misuse of the service or of intellectual property.
Disputes between a venue, act, or sound professional are theirs to resolve. EightGig may record what happened and apply product consequences, but we are not a party to your booking and cannot decide your claim against each other.
Ending use and changes
You may deactivate your account. Terms that protect shared booking history, content rights already granted, disputes, and service integrity may survive. We may update these terms; material changes will receive reasonable notice before taking effect.
